I. GENERAL PROVISIONS
- These Terms and Conditions (“Regulations”) govern participation in events organized by Refactore sp. z o.o. (“Organizer”).
- By purchasing a ticket or entering the Event Area, the participant agrees to these Regulations.
- The Regulations apply to all individuals present at the event, regardless of ticket type or role.
- Events are organized in accordance with applicable Polish law, including the Act on the Safety of Mass Events.
II. DEFINITIONS
- Ticket – a document entitling entry to the event
Identifier – a wristband issued upon entry; must be worn at all times
Event Area – designated premises of the event
Participant – any person attending the event
Security Services – authorized personnel responsible for safety and order
Token – internal event currency (non-refundable unless required by law)
III. TICKET PURCHASE AND CONTRACT
- The purchase of a Ticket constitutes a binding agreement between the Participant and the Organizer.
- Ticket sales may be conducted via third-party providers (e.g., Eventix, Weeztix), who act as separate data controllers/payment processors.
- The Organizer is not responsible for technical issues or payment processing errors on external platforms.
IV. TICKET POLICY
- Tickets may not be resold for commercial purposes without Organizer consent.
- Unauthorized resale or use of tickets for promotional purposes may result in cancellation without refund.
- Lost or damaged tickets may not be replaced. Entry requires exchange of Ticket for an Identifier (wristband).
V. ENTRY RULES
- Entry is permitted only with a valid Identifier.
Entry will be refused to persons:under the influence of alcohol or drugs, behaving aggressively or posing risk & carrying prohibited items
Security Services may conduct personal and bag checks.
VI. EVENT CONDUCT
- Participants must:follow instructions of Security and Organizer
respect other participants & use infrastructure responsibly
- Prohibited:
weapons, drugs, dangerous items, professional recording without consent, unauthorized commercial activity, bringing external food/drinks (except medical reasons)
VII. SAFETY AND LIABILITY
- Participation is at the Participant’s own risk.
- The Organizer is not liable for:
personal belongings, indirect or consequential damages, injuries resulting from failure to follow instructions
The Organizer is liable only to the extent required by mandatory law.
- Events may include loud sound, strobe lighting, and crowded environments.
VIII. EVENT CHANGES AND FORCE MAJEURE
- The Organizer reserves the right to change lineup, schedule, or venue within the same city.
No refund is due for lineup changes.In case of force majeure (e.g., weather, government decisions, safety risks),
the Organizer may cancel or reschedule the event.
Refunds in such cases will follow applicable law and ticket provider policies.
IX. IMAGE AND RECORDING RIGHTS
- WThe Event is a public event where photo and video recording takes place.
By entering, Participants acknowledge that their image may be captured.
The Organizer may use such recordings for promotion, marketing, and documentation.
If a Participant objects, they may contact the Organizer to request removal where feasible.
X. DATA PROTECTION
- The Organizer processes personal data in accordance with the Privacy Policy.
- The Organizer acts as data controller under GDPR.
XI. COMPLAINTS
- Complaints must be submitted in writing within 14 days.
Complaints will be processed within 21 days.
Issues related to event experience must be reported during the event.
XII. REMOVAL AND PENALTIES
- Violations may result in removal from the Event Area without refund.
Security Services may use measures permitted by law.
Participants may be held liable for damages caused.
XIII. GOVERNING LAW AND JURISDICTION
- These Regulations are governed by Polish law.
Any disputes shall be resolved by competent courts in Poland.
XIV. FINAL PROVISIONS
- The Organizer may update these Regulations at any time.
- The current version is available online and at the Event Area.
- If any provision is found invalid, the remaining provisions remain in force.
XV. REFUND POLICY
- Tickets are non-refundable, except in the case of full cancellation of the Event.
A “cancellation” means that the Event does not take place at all and is not rescheduled.
In the event of cancellation, Participants are entitled to a refund of the ticket price in accordance with applicable law and the terms of the ticketing provider.
- No refunds will be issued in the following cases:
changes to the event date, if the event is rescheduled
changes to the venue within the same city
changes to the lineup, artists, or program
personal inability to attend the Event
- If any provision is found invalid, the remaining provisions remain in force.
